Tesla trademark dispute resurfaces

After zooming into China with a slick publicity campaign earlier this year, electric car superstar Tesla (Nasdaq: TSLA) has run into a major new roadblock in one of its most promising markets over a trademark dispute. Tesla thought it had settled a matter that jumped into the headlines last summer as it was preparing to formally move into China. But apparently the trademark squatter who purchased the Tesla names in English and Chinese wasn’t satisfied, and has formally sued the company. China: Land of Apple Hunters 苹果在中国又吃官司

Last week’s settlement of a high-profile trademark dispute that appeared to mark a victory for Apple (Nasdaq: AAPL) has apparently done little to discourage others from pursuing the US tech giant in court, with 2 new cases making the headlines just days after announcement of an end to the original dispute. My only possible explanation for the strange timing in the announcement of these new cases is that perhaps the 2 plaintiffs saw that Apple agreed to pay $60 million for rights to the iPad name in China to a bankrupt company named Proview, and now think that they can perhaps get similar settlements in their own cases.

After months of haggling, Apple (Nasdaq: AAPL) has finally settled a high-profile trademark dispute with a bankrupt Chinese company over use of the iPad name, paving the way for the US tech giant to continue an aggressive ramp-up in a market that has become its second largest worldwide. News of this settlement looks good for not only Apple but also China, allowing the former to reclaim rights to the iPad name while showing companies that Beijing is committed to creating a business friendly environment for those who play by the rules.

New China Noise in iPad Dispute Bad for Apple 政府官员发表评论对苹果iPad之争不利

The latest noise coming from the high-profile trademark dispute over the iPad name doesn’t look too good for Apple (Nasdaq: AAPL), whose assertion that it legally owns the iPad name in China is being undermined by comments from one of the few government officials to comment on the matter. I wouldn’t read too much into the comments, as China often engages in this kind of media-based debate to gauge public sentiment on less sensitive commercial issue. Still, the fact that a government official is making comments that appear to favor the plaintiff in the matter, in this case a near-bankrupt company called Proview, indicate that a ruling against Apple is a distinct possibility. Then again, the comments could also be a quiet pressure tactic to get Apple to negotiate, which it has reportedly been reluctant to do as it believes it will win the case and doesn’t want to appear to be getting blackmailed. Let’s look at the actual comments, which have a senior official from the State Administration for Industry and Commerce saying that Proview is the legal registrant of the iPad name in China. (English article) In fact, anyone who has followed this case closely already knows that this is true. Based on my understanding, Proview was obligated by a larger global agreement several years ago to transfer the iPad name to Apple in China, but then the transfer failed to take place for what may have been technical reasons. So now instead of honoring its previous obligations, Proview is taking advantage of the situation to try and get Apple to buy the iPad name again, only this time for a much bigger price. The whole case is taking place in a South China courtroom, where the judge is apparently trying to mediate the dispute to find a solution that will make everyone happy. But Proview lawyers have indicated that Apple doesn’t want to negotiate. The US tech giant has also used other channels outside the courtroom to make its case, including a recent visit to top leaders by Apple CEO Tim Cook, and its recent decision to withhold its latest iPad from China until the dispute is resolved. (previous post) This latest comment from the government official doesn’t really state anything new, but the fact the official made the comment at all means the government probably wants Apple to show a little more willingness to negotiate in the case and provide everyone with a face-saving compromise. If Apple refuses to do that, it could very well find the court ruling against it, meaning legal iPads may not be available in China — which now accounts for a fifth of Apple’s sales — for a long time.

Bottom line: The latest comments from a government official in the iPad trademark dispute may be aimed at pressuring Apple to negotiate a settlement in the case.

More Proview Empty Talk in iPad Dispute 唯冠寻求禁售新款iPad将是徒劳之举

It’s been a week since I last wrote about Apple (Nasdaq: AAPL) and even longer since I wrote about its simmering trademark dispute with a failing Chinese electronics company, so I thought I would close out this Good Friday with some comments on the latest development in that story, which appears to be slowly turning in Apple’s favor. I should start off this post by repeating that I firmly support Apple in this dispute, not because I favor the big guy over the little guy, but rather because I think Apple is in the right and Beijing should send a clear signal that it won’t allow its legal system to become a playground for irresponsible companies to extort money. But let’s move beyond that and look at the latest news, which has the company, a nearly insolvent PC monitor maker named Proview (HKEx: 334), seeking to stop the import of Apple’s new iPad model to China pending resolution of the dispute over rights to the iPad name in China. (English article) Proview’s latest move comes just days after one of its creditors launched a failed bid to push the company into bankruptcy, with Chinese officials preferring to wait until the iPad trademark dispute is resolved. A Chinese court ruled in Proview’s favor in the case last year, after the company argued it had registered the trademark in China a decade ago, even though it stopped producing any products under the iPad name several years ago. Apple had purchased rights to the iPad name in a number of markets, including China, under a broader deal before the release of its popular line of tablet computers in 2010. But for reasons that have yet to be fully explained, at least not in the media, the trademark transfer was never officially consummated in China and thus Proview was still technically the holder of the iPad name for that market. Now, rather than admit it failed to complete its part of the iPad name sale, the financially struggling Proview is seeking to use its own failure to keep its word, Proview is attempting to earn some much-needed extra money by selling Apple a trademark that it technically already sold under the earlier deal. Apple, which has appealed the case to a higher court, won a victory in Shanghai earlier this year when a court in that city ruled that Proview couldn’t block the sale of iPads in Shanghai until the appeals court made its final ruling. (previous post) I suspect that any attempts to stop import of the new iPads by Proview under this latest move will also meet with similar failure, as Chinese customs officials probably don’t want to get involved in this dispute until they absolutely have to. Meantime, I also suspect that top leaders in Beijing may be getting involved in this case, following a meeting last week between Apple’s CEO Tim Cook and Chinese premier-in-waiting Li Keqiang (previous post), and I would say the chances for a final ruling in Apple’s favor are now better than 50 percent.

Bottom line: Proview’s latest move to block the new iPad from entering China is mostly talk, as the odds for victory in its trademark dispute with Apple sink below 50 percent.
